These terms govern your use of Hayya Boat. By creating an account or booking a trip, you agree to them. Please also read our Privacy Policy (PDPL). تحكم هذه الشروط استخدامك لهيّا بوت. بإنشائك حساباً أو حجزك رحلة فإنك توافق عليها. يُرجى أيضاً قراءة سياسة الخصوصية (PDPL).

1. Our role١. دورنا

Hayya Boat is a marketplace that connects passengers with independent, licensed boat captains. The trip itself is provided by the captain. We facilitate listing, booking, and payment, but we are not the operator of the vessel. هيّا بوت منصة تربط الركاب بنواخذة قوارب مستقلين ومرخّصين. الرحلة نفسها يقدّمها الربان. نحن نُيسّر العرض والحجز والدفع، لكننا لسنا مُشغّل القارب.

2. Accounts٢. الحسابات

You must provide accurate information and be legally able to enter into this agreement. You are responsible for activity on your account. يجب تقديم معلومات صحيحة وأن تكون مؤهلاً نظاماً لإبرام هذا الاتفاق. وأنت مسؤول عن النشاط في حسابك.

You must be 18 or over to register an account, make a booking or pay by card. A person under 18 may travel as a passenger, but only on a booking made and paid for by an adult, and only accompanied on board by a parent or legal guardian — see section 3. يجب أن يكون عمرك ١٨ عاماً فأكثر لتسجيل حساب أو إجراء حجز أو الدفع بالبطاقة. ويجوز لمن هم دون الثامنة عشرة السفر كركّاب فقط ضمن حجز أجراه ودفع قيمته شخص بالغ، وبشرط مرافقة أحد الوالدين أو الوصي الشرعي على متن القارب — انظر البند ٣.

3. Bookings & passenger details٣. الحجز وبيانات الركاب

• You may book a single seat or the whole boat (Private Group), subject to availability.يمكنك حجز مقعد واحد أو القارب كامل (مجموعة خاصة) حسب التوفّر.
• Every seat requires the passenger's full name, national ID or Iqama number, and date of birth, for the Coast Guard / Zawil manifest. Providing false details may void the booking and boarding.يتطلب كل مقعد الاسم الكامل ورقم الهوية أو الإقامة وتاريخ الميلاد للراكب، لقائمة حرس الحدود / زاول. وقد يؤدي تقديم بيانات غير صحيحة إلى إلغاء الحجز ومنع الصعود.

4. Prices, fees & VAT٤. الأسعار والرسوم والضريبة

The captain sets the price per seat. A Hayya Boat service fee and VAT are added at checkout and shown as itemised line items before you pay. All prices are in Saudi Riyals. يحدد الربان سعر المقعد. تُضاف رسوم خدمة هيّا بوت وضريبة القيمة المضافة عند الدفع وتظهر كبنود منفصلة قبل السداد. جميع الأسعار بالريال السعودي.

5. Payments٥. المدفوعات

Payments are processed by Telr, a licensed payment provider. Your booking is confirmed once payment is authorised. تُعالَج المدفوعات عبر «تلر»، وهي جهة دفع مرخّصة. ويُؤكَّد حجزك بمجرد اعتماد الدفع.

• We accept Visa, Mastercard, mada and Apple Pay. All transactions are charged in Saudi Riyals (SAR) only.نقبل بطاقات فيزا وماستركارد ومدى وآبل باي. وتتم جميع العمليات بالريال السعودي (SAR) فقط.
• Card details are entered on Telr's secure page and are never seen or stored by Hayya Boat.تُدخل بيانات البطاقة في صفحة «تلر» الآمنة، ولا تطّلع عليها هيّا بوت ولا تخزّنها.
• When your payment succeeds you receive confirmation by email immediately, and the booking appears under My Bookings with its reference number. If nothing has arrived within one hour, contact us before paying again.عند نجاح الدفع تصلك رسالة تأكيد بالبريد الإلكتروني فوراً، ويظهر الحجز في «حجوزاتي» برقمه المرجعي. وإذا لم يصلك شيء خلال ساعة، تواصل معنا قبل إعادة الدفع.
• We keep booking and transaction records, including the passenger manifest required by the maritime authority, for the period Saudi law requires. We do not retain card numbers.نحتفظ بسجلات الحجوزات والعمليات، بما فيها كشف الركاب المطلوب من الجهة البحرية المختصة، للمدة التي تفرضها الأنظمة السعودية. ولا نحتفظ بأرقام البطاقات.
• Keeping your account details confidential is your responsibility. Bookings made from your account are treated as made by you, so tell us at once if you believe someone else has used it.تقع عليك مسؤولية الحفاظ على سرية بيانات حسابك. وتُعامَل الحجوزات الصادرة من حسابك على أنها منك، لذا أبلغنا فوراً إذا اعتقدت أن شخصاً آخر استخدمه.

6. Cancellations & refunds٦. الإلغاء والاسترداد

• Free cancellation with a full refund up to 6 hours before departure.إلغاء مجاني مع استرداد كامل حتى ٦ ساعات قبل الانطلاق.
• No refund for cancellations made less than 6 hours before departure or for no-shows.لا استرداد عند الإلغاء قبل أقل من ٦ ساعات من الانطلاق أو عند عدم الحضور.
• If a captain cancels, or a trip is cancelled for weather or safety, you receive a full refund.إذا ألغى الربان، أو أُلغيت الرحلة بسبب الطقس أو السلامة، تحصل على استرداد كامل.
• Approved refunds go back to the card used to pay. Your bank decides when it appears on your statement — normally 10 to 45 days depending on the issuing bank. We do not refund to a different card or in cash.يُعاد المبلغ المسترد إلى البطاقة المستخدمة في الدفع. ويحدد البنك المصدر موعد ظهوره في كشف حسابك، وعادةً من 10 إلى 45 يوماً حسب البنك المصدر. ولا نعيد المبلغ إلى بطاقة أخرى ولا نقداً.

7. Safety & conduct on board٧. السلامة والسلوك على متن القارب

• Follow the captain's safety instructions at all times. The captain may refuse boarding for safety, intoxication, or unsafe behaviour.التزم بتعليمات السلامة من الربان في كل وقت. ويحق للربان منع الصعود لأسباب تتعلق بالسلامة أو السُّكر أو السلوك غير الآمن.
• Comply with all applicable Saudi maritime and safety regulations.الالتزام بجميع الأنظمة البحرية وأنظمة السلامة السعودية المعمول بها.

8. Women-only trips٨. الرحلات النسائية

Trips marked "Women only" are reserved for women passengers. Booking such a trip confirms eligibility. الرحلات الموسومة بـ "نساء فقط" مخصّصة للركاب من النساء. ويؤكد حجز هذه الرحلة الأهلية لها.

9. Captains' obligations٩. التزامات النواخذة

Captains must hold valid licences, keep their vessel and safety equipment compliant, list accurate trips, honour bookings, and submit the passenger manifest as required. يجب على النواخذة حمل التراخيص السارية، والحفاظ على مطابقة القارب ومعدات السلامة، وعرض رحلات دقيقة، والوفاء بالحجوزات، وتقديم قائمة الركاب وفق المطلوب.

10. Liability١٠. المسؤولية

As a marketplace, Hayya Boat is not liable for the conduct of captains or passengers or for the trip experience, except to the extent required by law. Nothing in these terms limits liability that cannot be limited under Saudi law. بصفتنا منصة، لا تتحمّل هيّا بوت مسؤولية تصرفات النواخذة أو الركاب أو تجربة الرحلة، إلا في الحدود التي يفرضها النظام. ولا يحدّ أي بند هنا من المسؤولية التي لا يجوز الحدّ منها بموجب الأنظمة السعودية.

11. Prohibited use١١. الاستخدام المحظور

Do not use Hayya Boat for any unlawful purpose, to provide false identity details, or to circumvent fees or safety requirements. لا تستخدم هيّا بوت لأي غرض غير مشروع، أو لتقديم بيانات هوية مزيّفة، أو للتحايل على الرسوم أو متطلبات السلامة.

12. Changes & governing law١٢. التعديلات والقانون الحاكم

We may update these terms; material changes will be notified in the app. Updates take effect on the day they are posted, so please check this page from time to time. قد نحدّث هذه الشروط؛ وسيتم الإشعار بالتغييرات الجوهرية داخل التطبيق. وتسري التحديثات من يوم نشرها، لذا يُرجى مراجعة هذه الصفحة من حين لآخر.

The Kingdom of Saudi Arabia is our country of domicile. These terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes fall under the jurisdiction of its competent courts. المملكة العربية السعودية هي بلد المقر النظامي لنا. وتخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص بالنظر في المنازعات محاكمها المختصة.

We will not trade with, or provide services to, any individual or entity that is subject to sanctions, or that is located in a country subject to OFAC or equivalent international sanctions. لن نتعامل تجارياً مع أي شخص أو جهة خاضعة للعقوبات، أو تقع في دولة خاضعة لعقوبات مكتب مراقبة الأصول الأجنبية (OFAC) أو ما يعادلها من العقوبات الدولية، ولن نقدّم لها خدماتنا.
